Waste Exemption Paragraph 14

Under the Waste and Contaminated Land (Northern Ireland) Order 1997 and the Waste Management Licensing Regulations (Northern Ireland) 2003, all activities involving the treatment, keeping or disposal of waste must be authorised by NIEA. Some activities are exempt from licensing if they meet the requirements of Regulation 17 of the Waste Management Licensing Regulations (Northern Ireland) 2003. If you want to operate under the terms of these exemptions you must register with NIEA. Schedule 2, Part 1, Paragraph 14 of the Waste Management Licensing Regulations (Northern Ireland) 2003 allows for the manufacture of timber products, straw board, plasterboard, bricks, blocks, roadstone, or aggregate, from waste; the manufacture of soil, or soil substitutes, from waste; the treatment of waste soil or rock which, when treated, is to be spread on land under paragraph 9 or 11; or the storage of waste which is to be subjected to any of the preceding activities.

Guidance

Waste stream(s) permitted

Waste arising from demolition or construction work, tunnelling or other excavations; or waste which consists of ash, slag, clinker, rock, wood, bark, paper, straw and gypsum. Waste soil or rock, which when treated, is to be spread on land under a Paragraph 9 or 11 exemption.

Storage and location

Waste must be stored at the place where the activity is to be carried on and the total quantity of waste stored must not exceed 20,000 tonnes.

Additional conditions

The manufacture of soil or soil substitutes must be carried out at the place where either the waste is produced or the manufactured product is to be applied to land under paragraph 9 or 11.

The total amount of soil, or soil substitutes, manufactured at that place on any day must not exceed 500 tonnes.

The treatment of waste soil or rock must be carried out at the place where the waste is produced or the treated product is to be spread.

The total amount of waste soil or rock treated at that place on any day must not exceed 100 tonnes.

Documentary evidence must be provided to demonstrate that the manufacturing activity will result in a product.
