Waste Exemption Paragraph 19
Under the Waste and Contaminated Land (Northern Ireland) Order 1997 and the Waste Management Licensing Regulations (Northern Ireland) 2003, all activities involving the treatment, keeping or disposal of waste must be authorised by NIEA. Some activities are exempt from licensing if they meet the requirements of Regulation 17 of the Waste Management Licensing Regulations (Northern Ireland) 2003. If you want to operate under the terms of these exemptions you must register with NIEA.Schedule 2, Part 1, Paragraph 19 of the Waste Management Licensing Regulations (Northern Ireland) 2003 allows specified wastes to be used and stored for the purpose of relevant work. Relevant work means work for the purposes of construction, maintenance or improvement of:(a) a building, road, railway, airport, dock or other transport facility (b) recreational facilities (c) drainage; or (d) a waterway but does not include any work involving land reclamation.
Before you apply- There is a £725.00 fee.
- You will need a credit or debit card.
You'll need to provide copies of the following:
- Proof of occupancy / entitlement.
- Planning permission (including stamped drawings)/confirmation from council.
- Site location plan or map.
- Cross sections.
- Pollution risk assessment.
- Contaminated waste analysis (if appropriate).
You may also need to provide consents of the following:
- Landowner / Landlord.
- Occupant.
- Partnership.
You will be prompted to login / register with the DAERA Central Authentication Service.
Guidance
Quantity
The waste must be used in accordance with the planning permission granted (if required) and must not exceed the dimensions of the final cross sections shown on any plan required to be submitted with the application.
Storage and location
Waste may be stored on a site where relevant work is taking place or is to take place and can be stored for a period not exceeding 3 months. No more than 20,000 tonnes of waste consisting of road plannings and roadbase, which are to be used for the purposes of construction, maintenance or improvement, to be carried on elsewhere, may be stored.
Additional conditions
The waste must be suitable for the purposes of the relevant work.
The waste must be used in accordance with any planning permission where such permission is required.
